Article 44 under Part IV of the Constitution of India provides for the following -

"The State shall endeavour to secure for the citizens a uniform civil code throughout the territory of India."

However, the Indian State under successive governments has always caught the cold feet while implementing the same. However recently, the current NDA government led by BJP has now agreed to implement it with vigour on our diverse nation. The law commission has also sought the comments on the draft from the general and eminent citizens. Not surprisingly, there are voices (which are legitimate) too which have started speaking against the application of UCC on our country by disagreeing with the whole exercise. However, more than often the debates gets muddled with political biasness, mudslinging, religious cacophony and vicious hate in the garb of defending ones position.

Hence, to discuss the same we have with us our eminent guest Mr. Rohit Pathania Ji who recently has also wrote the article on his blog providing with many rational and robust arguments against UCC (in the Indian context) and why the time has not come (yet) to implement it on our nation.

We discuss the following points -

a. UCC - Brief Background

b. Arguments against it

c. Examining the UCC Draft Bill of Uttarakhand

d. Follies of UCC

e. Conclusion

Also, we are posting the link below of the article written by Mr. Rohit Pathania Ji on his blog. Please do refer for more clarity on the subject.
