Geofence warrants, also known as reverse-location warrants, allow law enforcement to request data from technology companies like Google to identify all devices within a specified geographic area during a certain time frame. This lack of specificity contrasts with the Fourth Amendment's requirement that warrants must particularly describe the place to be searched and the persons or things to be seized.
- Overbreadth: These warrants often cover large areas and extended time periods, making them overbroad. They can include locations where suspects are unlikely to be and times when suspects are known not to be present, thus encompassing many innocent people. This broad scope is similar to general warrants, which were explicitly rejected by the framers of the Constitution because they allowed indiscriminate searches.
- Privacy Concerns: The collection of such vast amounts of location data intrudes significantly on individual privacy. Data from sources like Google’s Sensorvault, which stores detailed location information, can reveal intimate details about a person's life, such as where they live, work, and visit, raising substantial privacy concerns.
- Potential for Misuse and Errors: Geofence warrants can lead to false positives, implicating innocent individuals who happen to be in the area. There have been instances where people were wrongfully detained based on inaccurate location data.
