On this episode, Kirk Stange discusses psychosexual evaluations, which are detailed assessments used in child custody cases when sexual abuse is alleged or a parent is considered a risk. They involve clinical interviews, psychological testing, and sometimes physiological measurements to determine the individual's sexual behaviors and potential risk. He also discusses how courts utilize the results to decide parenting time, potentially limiting or supervising visits if concerns are found. This episode explores the debate over no-fault divorce, which allows couples to divorce without proving fault. Critics argue it weakens marriage and contributes to family breakdown. A motion to compel in family law litigation is filed when one party fails to respond to discovery requests (like interrogatories or document requests) or provides incomplete responses. The motion asks the court to order the non-compliant party to answer fully. Judges typically review the responses and may impose deadlines, sustain objections, or award attorney’s fees if misconduct is evident. This process helps ensure both parties share the necessary information for divorce or family law cases. Many people are familiar with the concept of parental alienation, but fewer are aware of the term "realistic estrangement." Parental alienation occurs when one parent intentionally seeks to undermine the other parent's relationship with their children, often through a prolonged effort to demean or defame them. While this process can take time to fully take effect, it can severely damage the targeted parent's bond with their children once it does. In contrast, realistic estrangement refers to a situation where the children choose to distance themselves from one parent, not because of manipulation by the other parent, but due to that parent's own inappropriate or harmful behavior. In this case, the children's reluctance to maintain a relationship is a direct response to the parent's actions and therefore is considered justified. During a divorce or family law deposition, one attorney asks the witnesses under oath to discover relevant information. Information is relevant if reasonably calculated to lead to the discovery of admissible evidence. During the deposition, the other attorney in the case can also ask the witness questions. Mediation is a popular alternative dispute resolution method in divorce or family law matters. Many opt to participate in mediation seeking a settlement outside of court. Many picture being alone in a room with the mediator and the other party. In that room, they envision a scenario where both parties and the mediators talk, devise solutions, and resolve the case. Sometimes, having both parties in the same room is not a good idea. Arguing and bickering might occur if the parties are in the same room. The probate court can be a slow, cumbersome, and costly process. On the other hand, having a revocable trust can create a more straightforward, faster, and less costly process in the long run. Many in divorce and family law matters can fall into the trap of trying to convince opposing counsel of their side of the case. It can happen in a deposition where the lawyer for the opposing counsel takes on the role of good cop. It can happen in discovery responses where they start over-sharing. Sometimes, it happens in settlement negotations out of an urgent desire to settle the divorce or family law matter. Ultimately, the other attorney is a paid advocate for a party's spouse, ex-spouse, or whoever the opposing part may be. It is important for a party to never forget that this is the case.
